4. Where & How to Buy

- Consumption Lounges: Not permitted.
- Local Opt-Outs: Local municipalities and counties may enact zoning restrictions or outright ban recreational marijuana establishments.
5. Taxes & Payment
- Excise Tax: 16% excise tax on retail sales.
- Sales Tax: Standard state transaction privilege tax (TPT) of 5.6%.
- Local Tax: Local municipalities may impose additional TPT (ranging roughly from 1% to 3%+).
- Payment: Cash is king. Many dispensaries offer cashless ATM options.
6. Consumption Rules
- Permitted Locations: Private property.
- Prohibited Locations: Public places, open spaces, sidewalks, parks, businesses, and restaurants.
- Vehicles/Open Container: Illegal to consume in a vehicle. It is prohibited to operate any vehicle while impaired.
- Landlord/Employer: Landlords may prohibit marijuana use on their premises. Employers may maintain drug-free workplaces.
7. Home Cultivation
- Allowed: Yes
- Plant Count Limits: Up to 6 plants per adult.
- Household Caps: Maximum 12 plants per household, regardless of the number of adults. Must be enclosed, locked, and not visible from public view.
8. Penalties
- Over-Limit Possession: Possessing more than 1 oz but less than 2.5 oz is a petty offense (fines). Greater amounts carry harsher criminal penalties.
- Public Consumption: Petty offense.
- Sale to Minors: Felony offense.
- DUI Thresholds: Zero tolerance / impairment standard. Operating a vehicle impaired to the "slightest degree" is a DUI. No specific "per se" nanogram limit protects you if impairment is proven.
