3. Purchase & Possession Limits
Flower: 1 oz (28 g)
Concentrate: 8 g
Edibles: Up to 800 mg of THC
Note: An "ounce equivalency" applies per transaction (1 oz flower = 8 g concentrate = 800 mg edibles). You cannot purchase 1 oz of flower AND 8g of concentrate in the same transaction.
4. Where & How to Buy
Dispensaries: Licensed retail marijuana stores.
Delivery & Online: Delivery is legal but subject to local municipality opt-in (e.g., Denver allows it, but many others do not). Online ordering is for delivery or in-store pickup.
Consumption Lounges: Allowed as "marijuana hospitality businesses" or "hospitality and sales businesses," subject to local opt-in.
Local Opt-Outs: Widespread. Many municipalities and counties have opted out of allowing recreational marijuana sales entirely.
5. Taxes & Payment
Excise Tax: 15% on wholesale transfers.
Sales Tax: 15% special retail marijuana sales tax, plus the 2.9% state sales tax.
Local Tax: Local municipalities may levy their own additional sales taxes.
Payment: Cash or cashless ATMs at most locations.
6. Consumption Rules
Permitted Locations: Private property and licensed hospitality establishments.
Prohibited Locations: Public consumption is strictly prohibited (parks, sidewalks, ski resorts, concert venues).
Vehicles/Open Container: Illegal to consume in a vehicle. Products must be in a closed, sealed container during transport.
Landlord/Employer: Landlords can ban cultivation and use on their properties. Employers can fire employees for off-duty marijuana use.
7. Home Cultivation
Allowed: Yes
Plant Count Limits: Up to 6 plants per adult (maximum 3 mature/flowering).
Household Caps: Maximum 12 plants per household, regardless of the number of adults. Must be enclosed, locked, and not visible to the public. If minors live in or visit the home, plants must be strictly inaccessible to them.
8. Penalties
Over-Limit Possession: Petty offense or misdemeanor depending on amount over the limit.
Public Consumption: Fine and potential community service.
Sale to Minors: Felony.
DUI Thresholds: "Per se" standard allows prosecution if a driver has 5 nanograms or more of delta-9 THC per milliliter of blood. However, impairment can be charged even below this limit.
