4. Where & How to Buy
Dispensaries: Licensed dispensaries only. Drive-through and curbside pickup are permitted with local approval.
Delivery & Online: Recreational delivery to retail consumers is strictly prohibited. Online ordering is available for in-store pickup only.
Consumption Lounges: Permitted if local municipalities authorize on-site consumption lounges (at dispensaries or retail tobacco stores).
Local Opt-Outs: Municipalities and counties can prohibit retail cannabis businesses within their jurisdiction.
5. Taxes & Payment
Excise Tax:
Cannabis with ≤ 35% THC: 10%
Cannabis-infused products (edibles): 20%
Cannabis with > 35% THC: 25%
Sales Tax: Standard state sales tax applies (6.25%).
Local Tax: Municipalities/counties may impose up to a 3% local occupation tax.
Payment: Cash or cashless ATMs.
6. Consumption Rules
Permitted Locations: Private property and authorized consumption lounges.
Prohibited Locations: Public places, streets, parks, and near individuals under 21.
Vehicles/Open Container: Must be in a secured, sealed, odor-proof, and child-resistant container while in a vehicle. Transporting an open container is a Class A misdemeanor.
Landlord/Employer: Property owners and landlords can ban use. Employers may enforce zero-tolerance or drug-free workplace policies.
7. Home Cultivation
Allowed: No (For recreational users)
Plant Count Limits: Only registered medical cannabis patients may grow at home (up to 5 plants).
8. Penalties
Over-Limit Possession: Escalating fines and criminal misdemeanor/felony charges based on weight.
Public Consumption: Fines.
Sale to Minors: Felony.
DUI Thresholds: "Per se" limit exists. Prosecution allowed if driver has 5 nanograms or more of delta-9 THC per milliliter of whole blood (or 10 ng in other bodily substances).
