Resident vs. Out-of-State/Visitor: Both residents and visitors aged 21+ may purchase.
Reciprocity: Out-of-state medical patients from approved states can use the Maine medical program, but recreational limits apply if they purchase adult-use.
3. Purchase & Possession Limits
Combined Limit: Up to 2.5 oz (70.8 g) of cannabis or a combination of flower and concentrate.
Concentrate Limit: Out of the 2.5 oz limit, no more than 5 g can be marijuana concentrate.
Edibles: Count towards the 2.5 oz equivalent total. Edibles are capped at 10 mg THC per serving and 100 mg per package.
4. Where & How to Buy
Dispensaries: Licensed adult-use cannabis stores.
Delivery & Online: Limited adult-use delivery is legal. Municipalities cannot outright prohibit the delivery of adult-use cannabis, though they can regulate it. Deliveries are barred between 10:00 PM and 7:00 AM.
Consumption Lounges: Not permitted for recreational use.
Local Opt-Outs: Towns must explicitly "opt in" to allow physical retail stores; otherwise, they are prohibited by default.
5. Taxes & Payment
Excise Tax: Cultivators pay a wholesale excise tax.
Sales Tax: 10% state sales tax on adult-use retail sales.
Payment: Primarily cash and cashless ATMs.
6. Consumption Rules
Permitted Locations: Private residences and private property.
Prohibited Locations: Any public place, state parks, federal land, and anywhere tobacco smoking is banned.
Vehicles/Open Container: Illegal to consume in a vehicle. Products must be sealed during transport.
Landlord/Employer: Landlords can restrict smoking. Employers can enact workplace policies.
7. Home Cultivation
Allowed: Yes
Plant Count Limits: Up to 3 mature plants, 12 immature plants, and an unlimited number of seedlings per adult.
Household Caps: Cultivation must be on property owned by the grower (or with owner's written permission), out of public view, and secure from minors. Plants must be tagged.
8. Penalties
Over-Limit Possession: Can result in civil or criminal penalties depending on the amount.
Public Consumption: Civil fine of up to $100.
Sale to Minors: Criminal offense.
DUI Thresholds: Impairment-based. Operating a vehicle impaired by marijuana is an OUI (Operating Under the Influence). Officer observation determines impairment.
