ID Requirements: Valid government-issued photo ID (scanned at entry).
Resident vs. Out-of-State/Visitor: Both residents and visitors aged 21+ may purchase.
Reciprocity: Out-of-state patients can purchase medical if they have a valid state card, but adult-use is available to anyone 21+.
3. Purchase & Possession Limits
Flower: 2.5 oz (increased from 1 oz as of Jan 1, 2024).
Concentrate: 1/4 oz (approx 7 g).
Edibles: Product equivalent rules apply, bound by the 1/4 oz concentrate limit.
4. Where & How to Buy
Dispensaries: State-licensed retail stores only.
Delivery & Online: Home delivery is legal via licensed retail stores.
Consumption Lounges: Legal. Nevada is rolling out licensed consumption lounges, including those attached to dispensaries and independent venues.
Local Opt-Outs: Some counties and municipalities restrict operations, but sales are widespread in major tourist hubs (e.g., Las Vegas).
5. Taxes & Payment
Excise Tax: 10% retail excise tax on adult-use purchases.
Sales Tax: Standard state sales tax (approx 8.38% in Clark County).
Payment: Cash or cashless ATMs.
6. Consumption Rules
Permitted Locations: Private residences and licensed consumption lounges.
Prohibited Locations: All public places. It is illegal to consume cannabis on the Las Vegas Strip, in casinos, or in hotel rooms.
Vehicles/Open Container: Illegal to consume in a moving vehicle. Open containers must be inaccessible to the driver.
Landlord/Employer: Hotels/casinos strictly prohibit use (due to federal gaming laws). Employers can drug test, but recent NV law limits pre-employment rejection for testing positive for marijuana (with many exceptions for safety-sensitive jobs).
7. Home Cultivation
Allowed: Yes, but highly restricted.
Plant Count Limits: Up to 6 plants per person.
Household Caps: Maximum 12 plants per household. CRITICAL LIMITATION: You may only legally grow if you reside more than 25 miles from a licensed retail cannabis store (which excludes almost all residents of Las Vegas, Reno, etc.). Landlord permission is required.
8. Penalties
Over-Limit Possession: Misdemeanor or felony depending on the amount over the limit.
Public Consumption: Misdemeanor (up to a $600 fine).
Sale to Minors: Felony.
DUI Thresholds: Impairment-based. While Nevada previously used a strict "per se" nanogram limit, recent court rulings and legislative updates focus on actual physical impairment observed by law enforcement.
