4. Where & How to Buy
- Dispensaries: OLCC-licensed retailers.
- Delivery & Online: Legal. Retailers can deliver to residential addresses between 8:00 AM and 9:00 PM, provided the local jurisdiction has not opted out of delivery.
- Consumption Lounges: Not permitted. Businesses with state liquor licenses are considered public places and prohibit cannabis consumption.
- Local Opt-Outs: Counties and cities can prohibit licensed recreational marijuana businesses via voter approval.
5. Taxes & Payment
- Excise/Sales Tax: 17% state retail sales tax.
- Local Tax: Cities and counties may impose an additional local tax of up to 3%.

6. Consumption Rules
- Permitted Locations: Private residences.
- Prohibited Locations: Public places (streets, parks, playgrounds, hotel common areas). The Indoor Clean Air Act bans smoking/vaping in workplaces and within 10 feet of entrances.
- Vehicles/Open Container: Illegal to consume in a motor vehicle. Open container laws mandate it must be sealed or in the trunk.
- Landlord/Employer: Landlords may prohibit smoking (though not possession). Employers can enforce drug-free policies.
7. Home Cultivation
- Allowed: Yes
- Plant Count Limits: Up to 4 plants per residence.
- Household Caps: The limit is 4 plants per household/residence strictly, regardless of how many adults live there.
8. Penalties
- Over-Limit Possession: Violations are Class B violations, escalating to misdemeanors or felonies depending on amount.
- Public Consumption: Class B violation (fines).
- Sale to Minors: Felony.
- DUI Thresholds: Impairment-based. Oregon utilizes implied consent laws for breath, blood, or urine tests when DUII is suspected.
